I recognize the efforts of the organizers, officers, directors, volunteers, and staff of the 10/31 Consortium to host the Fifolet Halloween Festival. I also recognize that participation in said event includes inherent risks of injury or damage to me and to others. I further recognize and acknowledge the efforts of said organizers, officers, directors, volunteers, and staff to obtain full coverage insurance for participants in said festival, acknowledging their inability to obtain such blanket insurance coverage at reasonable and affordable prices. Therefore, in return for the privilege of participating as a vendor in the Fifolet Halloween Festival, I hereby give this, my unconditional waiver of liability and hold harmless agreement, to and in favor of the 10/31 Consortium and the Fifolet Halloween Festival, together with all of its organizers, officers, directors, volunteers, and staff. By this act, I agree forever to release 10/31 Consortium and the Fifolet Halloween Festival and all its contractors, officers, directors, volunteers, and staff from any and all liability for any injury or harm I may suffer as a result of participation in said event or activities preparatory or subsequent thereto. This act shall bind me, as well as my heirs, family and assigns. As a vendor participant, I am solely responsible for the behavior, well-being and safety of myself, any minor children brought under my care, and all of my personal belongings, including any animals, brought with me to the event. This waiver and hold harmless shall apply in favor of the 10/31 Consortium and the Fifolet Halloween Festival and all its contractors, officers, directors, volunteers, and staff, regardless whose act, fault or negligence shall have led to any such injury, harm or damage. Furthermore, this waiver and hold harmless shall apply in favor of the 10/31 Consortium, the Fifolet Halloween Festival, all its contractors, officers, directors, volunteers and staff regardless of who might institute any claim or action.

I hereby grant the 10/31 Consortium and the Fifolet Halloween Festival permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications and traditional media advertising, without payment or other consideration. I understand and agree that all photos will become the property of the 10/31 Consortium and the Fifolet Halloween Festival and will not be returned. I hereby irrevocably authorize the 10/31 Consortium and the Fifolet Halloween Festival to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo. I hereby hold harmless, release, and forever discharge the 10/31 Consortium and the Fifolet Halloween Festival from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
